Which documents must be submitted with the application?
The High Commissioner’s Office's processing of your application for free trial requires that you submit the following documents:
- Your final annual statement for 2022
- Your possible cohabitant/spouse's annual statement for 2022
- Your and your possible cohabitant/spouse's pay slips, allowance specifications or equivalent for the past three months, if your income has changed significantly since 2022
- Information about whether you have legal aid insurance or other insurance and whether the insurance company covers the costs of the case. If the insurance company has refused legal aid cover, you must use a copy of the refusal.
- Information about your counterparty's name and address
- Information about what the case is about (case presentation)
- Information about which outcome/result you want from the case (allegation).
- Information on why you believe that your wish for the outcome of the case/result of the case is the right one (reasons).
- Information about the opposing party's position on your claim (e.g. pleadings, copies of letters from the opposing party or similar)
- Any subpoena/subpoena draft or response as well as any additional pleadings (e.g. reply or rejoinder)
- In cases against public authorities or when submitting board decisions or similar, also a copy of the authority's or board's decision,
- In appeals, a copy of the 1st instance judgment.
