When can I apply for a free trial

The earliest you can apply for a free trial is when there is a current dispute between you and the other party.

As a starting point, a dispute exists when the parties to the case are familiar with and disagree with the claims that they have each asserted. Furthermore, it is a current dispute if it is or will be brought before the court.

If your counterparty brings a case against you, the earliest you can apply for a free trial is when you have received notification that you have been sued in a lawsuit.

In the event that your application for a free trial is submitted late, it will be rejected. Therefore, you should apply for a free trial in good time, so that the High Commissioner’s Office can finish processing your application before the end of the trial. The case is generally considered closed when the main hearing has taken place.
