Overall Assessment

In addition to the applicant’s financial circumstances and ability to pay the legal costs, the following are among the issues considered in the overall assessment whether legal aid can be granted or not:

  • the importance of the case to the applicant
  • the prospects of the applicant of winning the case
  • whether the issue at hand in the case is trivial or not
  • the size of the expected legal costs in relation to the subject matter of the case
  • the applicant’s behaviour in the emergence of the case
